By using our website, you agree to be bound by Mallorca Distillery SL Terms & Conditions, as stated below.
1. About these terms
These Terms of Service govern the purchase of products at mallorcadistillery.com (the “Website”) from Mallorca Distillery, S.L. (“Mallorca Distillery”) by the person placing an order (the “Customer”). “Consumer” means a Customer who is an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
By placing an order, the Customer confirms that they have read and accepted these Terms of Service, the Delivery & Returns terms, the Legal Notice, the Privacy Policy and the Cookie Policy. If the Customer is not happy with any of them, they should not place an order and may send any questions to info@mallorcadistillery.com.
CONTRACT FOR THE SUPPLY OF PRODUCTS & / OR SERVICES
Goods displayed on the Mallorca Distillery website amount to an invitation to treat and they do not constitute an offer to sell products or services at any price indicated from time to time. No contract for the supply of products or goods will be deemed to exist between you and Mallorca Distillery unless, and until, a confirmation email is sent to you by Mallorca Distillery confirming that the order that you have placed has been accepted and payment has been received. The confirmation email acknowledges acceptance by Mallorca Distillery of your offer to buy goods or services from Mallorca Distillery and this acceptance is effective regardless of whether or not you receive the acceptance email.

Mallorca Distillery provides this website and its content on an “as is” basis and no representations or warranties of any kind are implicit in respect to the website or its content. Mallorca Distillery refutes all such representations and warranties, including warranties in respect of merchantability and fitness for purpose. Mallorca Distillery does not warrant that information displayed on this site is complete, current or accurate.
LIMITATION OF LIABILITY
Mallorca Distillery SL, its directors, employees or other representatives will not be liable for damages arising out of or in connection with the use of the website, except as specifically stated above. This is a comprehensive limitation of liability that applies to all or any damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of income or profit, loss of or damage to property, loss of data and claims to third parties.

Mallorca Distillery reserves the right to change these terms and conditions at any time without prior notice. Any terms and conditions posted on the Mallorca Distillery website from time to time, are deemed to be the effective terms and conditions from the date of posting.
2. Delivery, cancellation, returns and statutory rights
Delivery, delivery charges, the right to cancel, returns, refunds, damaged products and the Consumer’s statutory rights are regulated only by the Delivery & Returns terms, which form part of these Terms of Service. If there is any conflict on these matters, the Delivery & Returns terms prevail.
3. Placing an order
To buy, the Customer must: (a) select the products and add them to the basket; (b) enter billing and delivery details; (c) choose a delivery method and a payment method; (d) review the order summary; and (e) submit the order by clicking the button marked “Order with obligation to pay” or equivalent. Before submitting, the Customer may check and correct any input errors and the contents of the basket.
You are advised that Credit Cards will be debited before Goods are shipped or before Services are activated by Mallorca Distillery. It is a criminal act to use a false name or a known invalid credit card to induce an order for Goods or Services and anyone who wilfully misuses an invalid or stolen credit card will be reported to the Police. We track the electronic fingerprints of orders placed on the Mallorca Distillery Website and report unlawful or suspected unlawful transactions to the appropriate authorities.
The contract is made in English. Mallorca Distillery keeps a record of each order and the Customer may request a copy at info@mallorcadistillery.com.
4. Prices and payment
Prices are shown in pounds sterling (£) and include VAT and alcohol duty. Delivery charges are shown before the order is placed and are included in the total price payable. The price that applies is the one shown when the order is placed.
The accepted payment methods are shown at checkout. The charge is made before the products are dispatched. Mallorca Distillery may cancel and refund orders where it detects reasonable signs of fraud, such as the use of a false identity or of an invalid or unauthorised payment method, and report them to the competent authorities.
5. Acceptance of the order and when the contract is made
Mallorca Distillery will acknowledge receipt of the order by email without undue delay. That acknowledgement is not acceptance of the order. The order is an offer to buy by the Customer. The sales contract is made when Mallorca Distillery has received full payment and sends the Customer the email confirming that the order has been accepted, to the address given in the order form.
6. Age restriction and responsible drinking
Only persons aged 18 or over may buy from Mallorca Distillery, and the Customer confirms that they are at least 18 when placing an order. The age verification and delivery conditions, including the “Challenge 25” policy, are set out in section 2 of the Delivery & Returns terms. Mallorca Distillery may cancel any order placed by a person under 18, refunding the amount paid. Please enjoy alcohol responsibly.
7. Product information
Mallorca Distillery seeks to ensure that product descriptions, images and information are accurate and up to date. If it finds an obvious error in price or description before accepting an order, it will inform the Customer, who may confirm the corrected order or cancel it with a full refund.
8. Our liability
Mallorca Distillery does not exclude or limit its liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be excluded or limited, and nothing in these terms affects the Consumer’s statutory rights. Subject to that, where Mallorca Distillery breaches these terms, it is liable to a Consumer for foreseeable loss and damage. Loss or damage is foreseeable if it is an obvious consequence of the breach or if it was contemplated by the Customer and Mallorca Distillery when the contract was made. Mallorca Distillery is not liable for delays or failures caused by events beyond its reasonable control, to the extent permitted by law.
9. Changes to these terms
Mallorca Distillery may amend these Terms of Service. Each order is subject to the version in force when it is placed, and amendments do not affect orders already accepted.
10. Complaints and dispute resolution
Any enquiry or complaint may be sent to info@mallorcadistillery.com or made by phone on +34 871 704 310. If a complaint cannot be resolved, Mallorca Distillery will tell the Consumer whether it is willing to use an alternative dispute resolution provider and, if so, which one: [ADR PROVIDER / NOT APPLICABLE].
11. Governing law and jurisdiction
These terms are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. A Consumer who lives in Scotland or Northern Ireland may also bring proceedings in the courts of Scotland or Northern Ireland respectively.
