TÉRMINOS DE SERVICIO (CONDICIONES GENERALES DE CONTRATACIÓN)

1. Objeto y aceptación

Los presentes Términos de servicio regulan la compra de productos en mallorcadistillery.com (el «Sitio web») entre Mallorca Distillery, S.L. («Mallorca Distillery») y la persona que realiza un pedido (el «Cliente»). «Consumidor» es el Cliente que actúa con un propósito ajeno a su actividad comercial, empresarial, oficio o profesión, conforme al Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios, aprobado por el Real Decreto Legislativo 1/2007 (la «Ley de Consumidores»).

Al realizar un pedido, el Cliente declara haber leído y aceptado estos Términos de servicio, las Condiciones de Envíos y Devoluciones, el Aviso legal, la Política de privacidad y la Política de cookies. Si no está conforme con alguno de ellos, debe abstenerse de realizar el pedido y puede dirigir sus dudas a info@mallorcadistillery.com.

2. Envíos, devoluciones, desistimiento y garantía

La entrega, los gastos de envío, el derecho de desistimiento, las devoluciones, los reembolsos, los productos dañados y la garantía legal se regulan exclusivamente en las Condiciones de Envíos y Devoluciones, que forman parte de estos Términos de servicio. En caso de contradicción en estas materias, prevalecen las Condiciones de Envíos y Devoluciones.

3. Proceso de compra

Para comprar, el Cliente debe: (a) seleccionar los productos y añadirlos a la cesta; (b) introducir los datos de facturación y de entrega; (c) elegir la modalidad de envío y el medio de pago; (d) revisar el resumen del pedido; y (e) confirmar el pedido mediante el botón «Pedido con obligación de pago» o equivalente. Antes de confirmar, el Cliente puede revisar y corregir los datos introducidos y el contenido de la cesta.

El contrato puede formalizarse en español o en inglés. Mallorca Distillery conserva los datos del pedido y el Cliente puede solicitar una copia a info@mallorcadistillery.com.

4. Precios y pago

Los precios se expresan en euros e incluyen el IVA y los demás impuestos aplicables, incluidos los impuestos especiales. Los gastos de envío se muestran por separado antes de confirmar el pedido. El precio aplicable es el vigente en el momento de confirmar el pedido.

Los medios de pago admitidos se muestran al finalizar la compra. El cargo se realiza antes del envío de los productos. Mallorca Distillery podrá cancelar y reembolsar los pedidos en los que detecte indicios razonables de fraude, como el uso de una identidad falsa o de un medio de pago no válido o ajeno, y comunicarlos a las autoridades competentes.

5. Aceptación del pedido y celebración del contrato

Mallorca Distillery acusará recibo del pedido por correo electrónico sin demora y, en todo caso, dentro de las 24 horas siguientes. El pedido constituye una oferta de compra del Cliente. El contrato de compraventa queda celebrado cuando Mallorca Distillery ha recibido el pago íntegro y envía al Cliente el correo electrónico de confirmación de aceptación del pedido, a la dirección facilitada en el formulario de pedido.

6. Edad mínima y consumo responsable

Solo pueden comprar en Mallorca Distillery las personas mayores de 18 años, y el Cliente declara serlo al realizar el pedido. Las condiciones de verificación y entrega se recogen en el apartado 2 de las Condiciones de Envíos y Devoluciones. Mallorca Distillery podrá cancelar cualquier pedido realizado por un menor, reembolsando el importe abonado. El consumo excesivo de alcohol es perjudicial para la salud: disfrute con moderación.

7. Información sobre los productos

Mallorca Distillery procura que las descripciones, imágenes e información de los productos sean exactas y estén actualizadas. Si detecta un error manifiesto de precio o de descripción antes de aceptar un pedido, lo comunicará al Cliente, que podrá confirmar el pedido corregido o cancelarlo con reembolso íntegro.

8. Responsabilidad

Mallorca Distillery responde frente al Cliente conforme a la ley. Nada en estos Términos de servicio excluye ni limita los derechos del Consumidor ni la responsabilidad que no pueda excluirse o limitarse legalmente, en particular la derivada de la falta de conformidad de los productos o de productos defectuosos. Mallorca Distillery no responde de los retrasos o incumplimientos debidos a causas fuera de su control razonable, en la medida en que la ley lo permita.

9. Propiedad intelectual, uso del Sitio web y protección de datos

El uso del Sitio web y los derechos de propiedad intelectual e industrial se rigen por el Aviso legal. El tratamiento de los datos personales se rige por la Política de privacidad y el uso de cookies por la Política de cookies.

10. Modificaciones

Mallorca Distillery podrá modificar estos Términos de servicio. A cada pedido se le aplicarán los vigentes en el momento de su confirmación, y las modificaciones no afectarán a los pedidos ya confirmados.

11. Reclamaciones y resolución de conflictos

Cualquier consulta o reclamación puede dirigirse a info@mallorcadistillery.com o al +34 871 704 310. El Consumidor conserva su derecho a acudir a los mecanismos de resolución extrajudicial de conflictos y a los juzgados y tribunales que resulten competentes conforme a la normativa aplicable.

12. Ley aplicable, jurisdicción e idioma

Estos Términos de servicio se rigen por la legislación española. Los Consumidores podrán acudir a los juzgados y tribunales que resulten competentes conforme a la normativa aplicable, incluidos los de su domicilio. Se facilitan en español y en inglés; en caso de discrepancia, prevalecerá la versión en español.

TERMS OF SERVICE (GENERAL TERMS AND CONDITIONS OF SALE)

1. Purpose and acceptance

These Terms of Service govern the purchase of products at mallorcadistillery.com (the “Website”) between Mallorca Distillery, S.L. (“Mallorca Distillery”) and the person placing an order (the “Customer”). “Consumer” means a Customer acting for purposes outside their trade, business, craft or profession, as defined in the Consolidated Text of the General Law for the Defence of Consumers and Users, approved by Royal Legislative Decree 1/2007 (the “Consumer Law”).

By placing an order, the Customer declares to have read and accepted these Terms of Service, the Delivery & Returns Terms, the Legal Notice, the Privacy Policy and the Cookie Policy. If the Customer does not agree with any of them, they must not place an order and may send any questions to info@mallorcadistillery.com.

2. Delivery, returns, withdrawal and guarantee

Delivery, shipping costs, the right of withdrawal, returns, refunds, damaged products and the legal guarantee are regulated exclusively by the Delivery & Returns Terms, which form part of these Terms of Service. In the event of any conflict on these matters, the Delivery & Returns Terms prevail.

3. Ordering process

To buy, the Customer must: (a) select the products and add them to the basket; (b) enter billing and delivery details; (c) choose a delivery method and a payment method; (d) review the order summary; and (e) confirm the order by clicking the “Order with obligation to pay” button or equivalent. Before confirming, the Customer may review and correct the data entered and the contents of the basket.

The contract may be concluded in Spanish or English. Mallorca Distillery keeps the order data and the Customer may request a copy at info@mallorcadistillery.com.

4. Prices and payment

Prices are shown in euros and include VAT and all other applicable taxes, including excise duties. Shipping costs are shown separately before the order is confirmed. The price that applies is the one in force when the order is confirmed.

The accepted payment methods are shown at checkout. The charge is made before the products are dispatched. Mallorca Distillery may cancel and refund orders where it detects reasonable signs of fraud, such as the use of a false identity or an invalid or unauthorised payment method, and report them to the competent authorities.

5. Acceptance of the order and conclusion of the contract

Mallorca Distillery will acknowledge receipt of the order by email without delay and in any case within 24 hours. The order is an offer to buy by the Customer. The sales contract is concluded when Mallorca Distillery has received full payment and sends the Customer the email confirming acceptance of the order, to the address given in the order form.

6. Minimum age and responsible drinking

Only persons aged 18 or over may buy from Mallorca Distillery, and the Customer declares to be so when placing the order. The age verification and delivery conditions are set out in section 2 of the Delivery & Returns Terms. Mallorca Distillery may cancel any order placed by a minor, refunding the amount paid. Excessive alcohol consumption is harmful to health: please drink responsibly.

7. Product information

Mallorca Distillery seeks to ensure that product descriptions, images and information are accurate and up to date. If it detects an obvious error in price or description before accepting an order, it will inform the Customer, who may confirm the corrected order or cancel it with a full refund.

8. Liability

Mallorca Distillery is liable to the Customer in accordance with the law. Nothing in these Terms of Service excludes or limits the Consumer’s rights or any liability that cannot legally be excluded or limited, in particular liability arising from a lack of conformity of the products or from defective products. Mallorca Distillery is not liable for delays or failures caused by events beyond its reasonable control, to the extent permitted by law.

9. Intellectual property, use of the Website and data protection

Use of the Website and intellectual and industrial property rights are governed by the Legal Notice. The processing of personal data is governed by the Privacy Policy and the use of cookies by the Cookie Policy.

10. Changes

Mallorca Distillery may amend these Terms of Service. Each order is subject to the version in force when it is confirmed, and amendments do not affect orders already confirmed.

11. Complaints and dispute resolution

Any enquiry or complaint may be sent to info@mallorcadistillery.com or made by phone on +34 871 704 310. The Consumer retains the right to use out-of-court dispute resolution mechanisms and to bring proceedings before the courts that are competent under applicable law.

12. Governing law, jurisdiction and language

These Terms of Service are governed by Spanish law. Consumers may bring proceedings before the courts that are competent under applicable law, including those of their place of residence. They are provided in Spanish and English; in the event of any discrepancy, the Spanish version prevails.
